Terms & Conditions

By booking a session with Syms Photography Canberra, you agree to the following terms and conditions. These terms are designed to ensure clarity, fairness, and professionalism in all client relationships.

1. Booking, Fees & Payment

Photography services are billed at a rate of $100 per hour, inclusive of both shooting and post-production (editing) time.
A deposit of may be required to confirm your booking. This deposit is non-refundable and secures your session time, But is only necessary on a case-by-case basis.
The remaining balance is due prior to delivery of final images. Late payments may result in a delay in delivery.
Accepted forms of payment include: Cash payments, credit card, and bank transfer.

2. Copyright & Usage Rights

Photographer’s Rights:

All photographs remain the intellectual property of the photographer and are protected by copyright law.
The photographer reserves the right to use any image taken during a paid session for portfolio, promotional, website, and social media use unless a written agreement is made in advance requesting confidentiality.

Client Usage:

Upon full payment, clients are granted a royalty-free, perpetual license to use the delivered images for personal and commercial purposes, including marketing, websites, and social media.
Clients may not claim authorship or resell the images without written permission from the photographer.

3. Editing, Retouching & Artistic Discretion

Clients may request a general editing style or theme (e.g., warm tones, vintage, minimal), which will be taken into account.
All final edits are made at the sole artistic discretion of the photographer, based on professional standards and creative vision.
Clients may not direct the editing process in a granular or ongoing way ("micromanage"). One round of light revisions is included. Significant alterations or further revisions will be billed at the standard hourly rate.
All edit requests must be submitted within 7 calendar days of image delivery. After this period, the photographer is not obligated to provide additional revisions.

4. Delivery & File Handling

Edited digital images will be delivered via secure online gallery or file transfer service within 10 business days from the shoot date.
The photographer is not responsible for the loss of images after delivery. Clients are encouraged to download and securely store all files promptly.
Image galleries will remain available for 30 days post-delivery. Extended storage is not guaranteed unless a maintenance fee is arranged.

5. Cancellations, Rescheduling & Refunds

Cancellations must be made at least 48 hours before the scheduled session. Sessions cancelled with less notice may result in forfeiture of the deposit.
In the event of unforeseen circumstances (e.g., weather, illness), sessions may be rescheduled once without penalty.
Refunds are not available for completed sessions. If the photographer is unable to deliver services due to an emergency or equipment failure, a full refund will be provided in the case of pre-payment.

6. Client Responsibility & Model Release

Clients are responsible for ensuring that all participants in the shoot are informed and have provided consent.
Unless explicitly declined in writing, clients grant permission for the photographer to use images of recognizable individuals in promotional and portfolio materials.
The client is responsible for obtaining any necessary permissions or permits for shooting on private property or restricted locations.

7. Limitation of Liability

While every effort will be made to ensure client satisfaction, the photographer shall not be held liable for circumstances beyond control, including but not limited to weather, lighting conditions, technical malfunctions, or subjects’ failure to cooperate.
The photographer is not liable for any damages, loss of business, or emotional distress resulting from the use or misuse of delivered images.

8. Revisions to Terms

These Terms & Conditions are subject to change at any time without prior notice. Clients will be notified of material changes prior to their shoot date.
